They are distinct parts of the §1557 rule: the patient-care decision-support-tool provision targets discrimination via clinical algorithms and AI, while separate provisions address discrimination on the basis of sex including gender identity — different subjects, different legal histories, and different litigation exposure. The algorithm provision is the one relevant to AI auditing.
